Part one — introduction

1. About these terms

These terms govern your use of mio.farm and everything you buy through it: a share in a farm's season, products from a farm's shop, and a farm's courses and events.

There is one set of terms for everyone, set by mio.farm. It has three groups of sections. Sections 4 to 15 are your agreement with the farm you buy from. Sections 16 to 18 are the agreement between you and Falkasete AS, which runs mio.farm. Section 19 sets out what each farm has agreed with mio.farm; a farm accepts section 19 when it opens a farm on mio.farm. Sections 1 to 3 and 20 to 22 apply to everyone.

What you buy is described on the farm's own page and on the purchase screen at the moment you buy: the share, product or event, its price, and the farm's own practical rules (for example pickup days, holiday handling and any work days). That description, together with these terms, is your agreement. If a farm's own rule conflicts with these terms, these terms apply, unless the farm's rule is more favourable to you.

2. Who the parties are

The farm — the seller

The farm you buy from is the seller. The farm grows, makes or provides what you buy, delivers it, sets its own prices, and is responsible to you for what was agreed. The farm receives your payment directly into its own account.

Each farm shows, on its page, its name, the place it farms, and a way to contact it. A farm that sells as a business also shows its legal name, its organisation number and its address.

mio.farm — the marketplace

mio.farm is provided by Falkasete AS, organisation number 988 195 154, Skreddarstuva 141, 4160 Finnøy, Norway (“mio.farm”, “we”, “us”). mio.farm is a marketplace: we provide the website, your account, and the tools a farm uses to offer shares, products, events, pickups and work days, and we pass your payment to the farm through our payment provider.

mio.farm is not the seller, is not a party to your agreement with the farm, and does not grow, make, handle or deliver what you buy.

The owner of Falkasete AS also runs a farm, Falkasete, which sells on mio.farm. That farm is treated like any other farm: it accepts these same terms, its buyers pay the same service fee, and it is listed, shown and reviewed by the same rules, with no preference on maps, in lists or in search.

Some farms are run by a business, and some by a private person or an association. The farm's page shows whether the farm sells as a business. Consumer protection law gives you the strongest rights when the seller is a business; some of those rights may not apply when you buy from a private person who is not acting as a business.

3. Accepting these terms

Before you pay, you confirm that you have read and accept these terms and the farm's own rules shown at that moment. You do this with one tick; there is only one set of terms to accept, not several. You cannot complete a purchase without accepting.

We record which version of these terms, and which version of the farm's rules, you accepted, and when. The version date is shown at the end of this page. You can open these terms at any time from your account and from any farm's page.

You must be at least 18 years old to buy in your own name. The information you give when you buy and in your account must be correct.

Part two — what you can buy from a farm

4. Farm shares

A share is your part of one farm's harvest for one season. By buying a share you agree to support the farm for the whole season, and the farm agrees to share its harvest with you.

Before you buy, each share shows: the season, with its expected start and end; the estimated number of deliveries and roughly what a delivery contains; the pickup point or points, with day and time; the total price for the season, if there is one; and the number of work days required, if any.

The amount and content of each delivery vary with the harvest. Weather, the season, pests and other natural conditions decide what grows and when. Some weeks give more and some give less, and the start and end of the season may move. This shared risk is the nature of community-supported agriculture: members share both the good and the poor years with the farm. The figures shown on a share are the farm's honest best estimate, not a promise of a fixed quantity.

The farm commits to: give its honest best estimate of the season and the deliveries before you buy; tell members in good time of any change to pickup day, time or place; tell members as soon as possible, with the reason, if the harvest is expected to be much smaller than estimated, or if deliveries must be cancelled or moved; and grow, store and hand over food in line with the food-safety rules that apply to the farm.

Shared harvest risk is the agreed content of your share. It does not reduce your rights as a consumer, and it does not allow the farm to stop delivering without good reason. Section 13 explains what happens if the farm ends the season early.

5. Three kinds of share

Each farm decides which kinds of share it offers:

  • Payment only. You pay the price for the season and collect your share. Helping with work is welcome but voluntary.
  • Payment and work days. You pay the price for the season and also do the number of work days shown on the share.
  • Work only. You give work days instead of money and receive a share of the harvest in return.

Your obligation is the one shown on the share you chose, as it was shown when you bought: the price, the number of required work days, and the estimated number of deliveries. The farm cannot raise your price or your required work days for the same season without your agreement.

Work given for a share is community participation, not employment. It does not make you an employee of the farm or of mio.farm.

6. The farm shop: products

A farm may sell individual products in its shop, for example vegetables, eggs, preserves, teas, or crafts such as salves and soaps. Each product shows its price, whether it is collected at a pickup point or can be posted, and, where it applies, its weight.

A product can be priced per item, or by weight. For a product sold by weight, the farm registers each individual piece with its real weight, and the price of that piece is its weight times the farm's price per kilo. You buy a specific piece at the exact price shown.

Stock is limited to what the farm has. If a product sells out while you are buying, the farm does not owe you that product; if you were charged for a piece that was no longer available, you are refunded in full for it.

Some products may only be sold by a farm that holds the right registration or approval. Prepared food, such as ready meals, may only be sold by a registered food business (Mattilsynet in Norway, MAST in Iceland). Cosmetic products, such as creams and salves, must meet the rules that apply to cosmetics. The farm is responsible for holding the registrations, approvals and safety documentation its products require; see section 19. mio.farm does not inspect products or premises.

7. Courses and events

A farm may offer courses and events, for example a workshop, an open day or a guided walk. Each one shows the date and time, the place, the number of places, the price, and what is included.

When you sign up, you hold a place for the number of people you booked. If the farm cancels the event, or moves it to a time you cannot attend, you are refunded in full, including the service fee. If you cancel your own place, section 13 explains when you are refunded.

Part three — how a purchase works

8. Buying, and when the agreement is made

You buy on mio.farm by choosing a share, product or event, choosing how you will receive it where there is a choice, accepting these terms, and paying. There is no separate application step and no waiting for the farm to approve you.

Your agreement with the farm is made when your payment is completed. From that moment the farm must provide what you bought, as described, and you have the rights set out in these terms and in the law. We confirm your purchase by email and in your account, with the details and these terms.

If a farm is marked as full, you may be able to join its waitlist. Joining a waitlist is free and binds no one. A place offered from the waitlist becomes an agreement only when you buy it as above.

9. Price, payment and the service fee

You pay on mio.farm, by card, through our payment provider Stripe. The farm is the seller: the price goes directly to the farm's own Stripe account, and the farm's name is on your receipt. Payment outside mio.farm is not offered. mio.farm never holds the price for you.

The price shown by the farm includes any value added tax the farm must charge.

mio.farm adds its own service fee on top of the farm's price. The fee is 6 % of the price, with a small minimum per currency so very small orders are worth processing (6 NOK, 6 SEK, 4 DKK, 85 ISK, €0.50, £0.45 or $0.55). The fee is shown as its own line before you pay, and it is the only amount mio.farm receives. The farm pays mio.farm nothing. No service fee is charged on postage.

You may pay in your own currency where your card supports it; Stripe sets the exact amount and any currency-conversion cost is included in the amount shown before you pay. The farm is paid in its own currency.

A refund of the price is made by the farm, from the farm's own account. When the price of an item is refunded in full, mio.farm refunds its service fee for that item in proportion; no fee is charged on a refunded item.

If a farm offers payment in instalments, the dates and amounts are those stated when you buy. Work-only shares have no price and no payment; your work days are your contribution.

10. Delivery, pickup and collection

You receive what you bought in the way shown when you bought it: collected at a pickup point on the day and within the time shown, or, for a product the farm marks as postable, sent to you by post. Postage, where it applies, is set by the farm and shown before you pay.

If you will be away, tell the farm in advance. Unless the farm's rules say otherwise, you may let someone else collect for you. A share delivery or product that is not collected within the pickup time is forfeited, without a refund or replacement, unless the farm agrees otherwise; the farm may give uncollected fresh food to others so that nothing is wasted. Some farms have their own rules for holidays and missed pickups, shown on the farm's page, which apply in addition to this section.

11. Work days

A work day is a period of work for the farm that the farm has arranged or approved: field work such as sowing, planting, weeding and harvesting; packing and distribution; building and maintenance; or organising tasks such as planning, communication and coordinating pickups. The farm shows how long a work day is. You sign up for work days on mio.farm, or as the farm tells you. Where you can, spread your work days over the season, and if you cannot come on a day you signed up for, tell the farm as early as you can and choose another day.

Work is not only heavy physical work. Light tasks, seated tasks and organising tasks count fully as work days. If you have a disability or a health condition, tell the farm what you are able to do; you do not have to say why, and the farm will offer suitable tasks where it reasonably can.

If illness, injury, pregnancy, caring duties or another good reason stop you from doing your work days, tell the farm. The farm will look for a fair solution with you, such as moving the days, lighter tasks, or letting someone from your household or a friend do the days for you. You will not lose your share because of illness without the farm first trying to find such a solution.

If required work days are not done and no fair solution has been found, the consequence is the one shown on the share when you bought it, for example an amount stated by the farm. If the share showed no consequence, you and the farm agree on a fair solution. The farm may not charge an amount that was not shown on the share.

Part four — changing your mind, cancellation, problems

12. Right of withdrawal

When you buy as a consumer from a farm that sells as a business, at a distance through mio.farm, you normally have a right to withdraw within 14 days without giving any reason, under the Norwegian Right of Withdrawal Act (angrerettloven) and, for farms in Iceland, the Icelandic Act on consumer contracts (lög um neytendasamninga nr. 16/2016). These rights come from the EU Consumer Rights Directive (2011/83/EU) and apply across the EEA.

The law makes exceptions that matter here:

  • Fresh, perishable food is excepted: once a delivery of fresh food has been made, that delivery cannot be withdrawn.
  • Courses and events tied to a specific date are excepted: there is no 14-day withdrawal for them. The farm's cancellation rule in section 13 applies instead.
  • A piece made or weighed specifically for you, such as a weighed cut booked to you, may be excepted where it cannot be resold.

For a season share, which is a contract for regular deliveries over a period, the 14 days run from the day you receive the first delivery. If you withdraw in time, the farm refunds what you have paid, less the value of deliveries you have already received, without undue delay and no later than 14 days after it receives your notice. For a product that is not perishable, the ordinary 14-day right applies from the day you receive it.

The farm is the seller, so you withdraw by telling the farm clearly before the deadline, for example by email, and any refund is made by the farm. You may use the standard withdrawal form, which you can fill in, copy or print, but you do not have to. It is enough that you send your notice before the deadline ends. If the farm did not tell you about the right of withdrawal as the law requires, the deadline is extended by up to 12 months.

The withdrawal page explains the right of withdrawal and its exceptions, with the standard form.

13. Cancellation and ending the agreement

A season share after the withdrawal period

A share is a commitment for the whole season, because the farm plans its sowing, work and costs for the number of members it has. After the withdrawal period you cannot end the agreement simply because you have changed your mind, unless the farm's rules shown when you bought allow it. You may always ask the farm to transfer your share to another person for the rest of the season; the farm must approve the new member and may not refuse without good reason. If you must stop for a serious reason you could not foresee, such as moving away or serious illness, contact the farm and you will look for a fair solution together.

Courses and events

If you cancel a place at a course or event 7 days or more before it starts, you are refunded in full. If you cancel later than that, there is no refund, unless the farm's rule for that event is more generous. If the farm cancels the event, you are refunded in full, including the service fee.

If you seriously breach the agreement

The farm may end the agreement if you seriously breach it, for example by repeatedly not paying, or by behaving in a way that puts other people at risk. Where it is reasonable, the farm must first give you a written warning.

If the farm ends the season early

If the farm ends the season early, cancels a large part of the deliveries, or stops operating, for reasons other than the natural variation of the harvest described in section 4, you are entitled to a proportional refund of what you have paid for the deliveries that were not made. Work days you have already done are taken into account. This does not limit any other right you have under consumer law.

14. If something is wrong

The farm is responsible to you if what you receive does not match what was agreed, or does not meet the quality and safety you can reasonably expect. When you buy as a consumer from a business, you have the rights in the Consumer Purchases Act (forbrukerkjøpsloven in Norway; lög um neytendakaup nr. 48/2003 in Iceland), which cannot be set aside to your disadvantage: for example repair, replacement, a price reduction, a refund, or compensation, depending on the case.

If something is wrong, contact the farm first and give it a chance to put it right. mio.farm may help you and the farm communicate, but mio.farm does not decide disputes between you and a farm. Section 21 tells you which complaint bodies you can also turn to.

Part five — on the farm and your account

15. On the farm: conduct and safety

A farm is a workplace, with machines, tools, animals, water and uneven ground. When you visit or work on the farm, follow the farm's instructions and safety rules, and do not use machines or tools unless the farm has shown you how and allowed you to. Wear clothing and footwear suited to the task and the weather. If you have a health condition or allergy that matters for a task, you may tell the farm; you decide what you share.

Children are welcome where the farm allows it; a child's parent or guardian is responsible for the child at all times, and children may only do tasks the farm agrees are suitable. Dogs and other animals may only come if the farm allows it and must be kept under control, following the farm's rules. Treat the farmer, other members and visitors with respect; harassment, discrimination, violence and threats are not accepted, and the farm may ask a person to leave. Report any accident or injury on the farm to the farm straight away.

16. Your account on mio.farm

Your account is personal. Keep your login details safe and the information in your account correct. Do not misuse mio.farm: this includes false orders, spam, trying to reach other people's data, and trying to disrupt the service. You are responsible for what you write on mio.farm, such as notes to a farm and suggestions for the season; it must not be unlawful or offensive, and we may remove content that breaks these terms. Suggestions you make on a farm's season-planning page are shown publicly with your display name.

We may suspend or close an account that seriously or repeatedly breaks these terms; where it is reasonable, we will warn you first and tell you why. You may close your account at any time with “Delete my account” on your account page. Closing your account does not by itself end an agreement you have with a farm — tell the farm as well. We may change, pause or stop parts of mio.farm; where possible we will tell you in reasonable time, and if mio.farm stops, your agreement with the farm continues directly between you and the farm.

17. Personal data

mio.farm processes personal data as described in our privacy notice, in line with the General Data Protection Regulation (GDPR) as it applies in Norway and Iceland.

When you buy from a farm, the farm receives the information it needs to serve you — for example your name, email address, what you bought, your pickup point, and any note you write — and becomes responsible, as an independent controller, for how it uses that information to run your membership and to meet its legal duties. The farm must use your data only for that purpose and in line with data-protection law.

Part six — responsibilities and legal

18. Liability

The farm is responsible to you for what you buy and its delivery, for the quality and safety of the food and other products, and for conditions on the farm, as set out in the agreement and the law.

mio.farm is responsible for running the marketplace with reasonable care. mio.farm is not responsible for a farm's performance of the agreement, for the food or other products, for what happens on a farm, or for the farm's handling of your data outside mio.farm. As an intermediary, mio.farm is not liable for indirect or consequential loss, or for interruptions caused by events outside our reasonable control, such as failures at hosting or payment providers, power cuts or extreme weather.

Nothing in these terms limits liability for intent or gross negligence, for personal injury caused by negligence, or any right you have under mandatory consumer law.

19. Terms for farms

This section is the agreement between a farm and mio.farm. A farm accepts it when it opens a farm on mio.farm. It is shown here so that members can see what every farm has agreed.

By opening a farm on mio.farm, the farm agrees that:

  • It is the seller. The farm sells directly to members, is the seller and merchant of record, receives payment into its own Stripe account, and is responsible to members for what it sells and delivers. mio.farm is a marketplace, not the seller.
  • It offers its shares, products and events on these terms. The farm's own rules may add practical detail but may not take away a member's rights under these terms or the law.
  • Its information is true and current. The farm keeps its name, legal identity, prices, stock, availability, pickup points and declarations accurate, and gives members honest estimates.
  • It follows the law. The farm holds and keeps current every registration, approval, licence, insurance and tax obligation that its activity requires. This includes business registration and VAT where they apply; registration as a food business (Mattilsynet in Norway, MAST in Iceland) before selling prepared food; and compliance with the rules for cosmetic products, including a safety assessment and any notification required, before selling creams, salves or other cosmetics. Selling to buyers in other countries may bring further duties, which are the farm's responsibility. mio.farm does not inspect products, premises or documents, and relies on the farm's declaration.
  • It handles members' data lawfully, as an independent controller, only to run memberships and meet its duties, in line with the GDPR.
  • It honours withdrawals, cancellations and refunds as set out in these terms and the law, accepts a notice of withdrawal made with the standard withdrawal form or in any other clear way, and makes refunds from its own account without undue delay.
  • It carries its own liability. The farm is liable to members, and to third parties, for what it sells and for what happens on the farm, and keeps mio.farm free from claims arising out of the farm's activity, its products, or its breach of the law, except where a loss is caused by mio.farm's own fault.
  • mio.farm's fee and role. mio.farm charges the member a service fee on top of the farm's price and the farm pays mio.farm nothing. mio.farm may show, review, hide or remove a farm's listings, and may suspend or close a farm that breaks these terms or the law; where it is reasonable, mio.farm will warn the farm first. Either side may end the farm's use of mio.farm with reasonable notice; agreements already made with members are completed or settled fairly.

20. Changes to these terms

We may change these terms, for example when the law changes or a feature is added. We will tell you about changes by email and on this page at least 30 days before they take effect, unless the law requires a shorter notice. A change does not alter an agreement already made for the current season to your disadvantage, unless you agree to it. If you do not accept a change to the platform terms, you may close your account. The version date is shown at the end of this page.

21. Governing law and disputes

Your agreement with a farm is governed by the law of the country where the farm is located: Norwegian law for farms in Norway, Icelandic law for farms in Iceland. The terms between you and mio.farm are governed by Norwegian law. Neither of these takes away any mandatory consumer protection you have under the law of the country where you live.

If you disagree with a farm, try first to solve it with the farm. As a consumer you may also bring a complaint to a consumer body: in Norway, the Consumer Authority and the Consumer Council (Forbrukertilsynet, Forbrukerrådet), which offer guidance and mediation, and the Consumer Complaints Board (Forbrukerklageutvalget); in Iceland, the Complaints Committee for Goods and Services (kærunefnd vöru- og þjónustukaupa). You may also take a case to the ordinary courts where the law gives you that right.

22. Contact

Questions about your share, a product, an event, payment or work days: contact the farm. Its contact details are on the farm's page.
